1. Service Description

Mastan AI ("Mastan," "we," "us," or "our") provides an artificial intelligence assistant accessible through WhatsApp and Telegram messaging platforms. By using our service, you agree to these Terms and Conditions in full.

2. User Eligibility

You must be at least 13 years of age to use Mastan. If you are between 13 and 18, you represent that you have your parent's or legal guardian's permission. We reserve the right to terminate accounts if we become aware of underage use without consent.

3. Account and Access

Your account is identified by your phone number (WhatsApp) or Telegram user ID. You are responsible for all activity under your account. Do not share access or allow others to use your account.

4. Acceptable Use

You agree not to:

• Use Mastan for any unlawful, harmful, or fraudulent purpose
• Attempt to generate content that is hateful, violent, sexually exploitative, or promotes self-harm
• Reverse-engineer, probe, or attempt to extract the underlying models, prompts, or system architecture
• Use automated scripts or bots to interact with Mastan at scale without written permission
• Impersonate another person or misrepresent your identity
• Use Mastan to spam, harass, or send unsolicited messages to others
• Circumvent usage limits, rate limits, or safety filters

Violation of this policy may result in immediate suspension or termination of your access.

5. AI-Generated Content

Mastan's responses are generated by artificial intelligence. While we strive for accuracy, AI outputs may contain errors, inaccuracies, or outdated information. You should not rely on Mastan for medical, legal, financial, or other professional advice. All AI-generated content is provided "as is" without warranty of accuracy or fitness for any particular purpose.

6. Payment Terms

Certain features of Mastan may require a paid subscription or one-time payment, processed through Stripe.

• Subscriptions renew automatically at the end of each billing cycle unless cancelled before the renewal date.
• Cancellation: You may cancel your subscription at any time. Access continues until the end of the current billing period.
• Refunds: We offer a 14-day refund window from the date of your initial subscription purchase. After 14 days, payments are non-refundable. One-time purchases are non-refundable once the service has been delivered.
• Price changes: We may adjust pricing with at least 30 days' notice. Continued use after a price change constitutes acceptance.

7. Intellectual Property

All Mastan branding, software, design, and proprietary technology remain our exclusive property. You retain ownership of the content you submit to Mastan. By using the service, you grant us a limited, non-exclusive license to process your inputs solely for the purpose of providing the service.

You may use AI-generated responses for personal or commercial purposes, but you may not claim that Mastan's outputs were created by a human, nor resell access to Mastan without written agreement.

8. Privacy

Your use of Mastan is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using Mastan, you consent to the practices described therein.

9. Service Availability

We aim to keep Mastan available 24/7, but we do not guarantee uninterrupted service. We may suspend or modify the service at any time for maintenance, updates, or other operational reasons without prior notice.

10. Limitation of Liability

To the maximum extent permitted by law:

• Mastan AI and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the service.
• Our total liability for any claims related to the service shall not exceed the amount you paid us in the 12 months preceding the claim.
• We are not responsible for any decisions or actions you take based on AI-generated content.

11. Indemnification

You agree to indemnify and hold harmless Mastan AI, its officers, employees, and agents from any claims, damages, or expenses arising from your use of the service or violation of these Terms.

12. Termination

We may suspend or terminate your access at any time, with or without cause, with or without notice. Upon termination, your right to use the service ceases immediately. Sections that by their nature should survive termination will survive (including liability, indemnification, and governing law).

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via the service or our website. Continued use after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
